Branding Deadlines

At the time of booking we will issue a timetable for artwork finalisation deadlines and/or branding production deadlines. The following increases can apply if a deadline is missed for any reason. Less than 14 days prior to event 10% increase, less than 10 days prior to event 15%, less than 7 days prior to event 20% increase. Missed deadlines can also result in us being unable to for fill branding production, in this instance bus hire charges would be non-refundable.

Expeditional: Terms and Conditions Private Hire Services

In these conditions any reference to the Company means Business B Limited trading as Expeditional.

Terms

The hirer means the individual, organization or representative of the organization that placed the booking with the company and made a payment.

Acceptance

The hirer at the point of first payment accepts these conditions whether this is in the form of a deposit, installment or full amount.

Company Responsibility

The company operates under strict vehicle licensing laws that govern standards of maintenance and operation, drivers hours and health and safety legislation. The company will only provide services to the hirer that meet these high standards.

The company shall not be responsible for loss or damage to luggage or other property brought onto the vehicle during or after the period of hire however caused.

Liability

The company’s liability in respect of any failure to provide any services under this agreement shall be limited to the amount of the hire charge of the company’s own vehicles only. The company shall not be liable for any damages or consequential loss arising or alleged from any failure to undertake a hire or agreement.

Substituted, outsourced, additional or supplementary vehicles and/or services hired to fore fill a hire or booking are subject to the terms and conditions of the third party supplier.

Vehicle Restrictions

a) Items such as, but not limited to; decorations and/or notices are not permitted to be displayed from the vehicle without the previous written consent of the company. Flammable liquids or explosives such as fireworks are also forbidden onboard at any time. Smoking is strictly forbidden onboard at any time.

b) The 1968 Road Traffic Act and any subsequent amendments, govern our drivers working hours. The hirer may not cause the hours of work or driving performed by the driver to break the law relating to drivers hours legislation.

c) The maximum number of passengers must be disclosed to the company by the hirer at the time of booking. The maximum number of passengers may not exceed the vehicles maximum legal capacity. Crews do not have discretion to carry extra passengers.

d) Permission for the carriage of luggage greater than hand luggage or for other personal items such as pushchairs and wheelchairs must be obtained in writing prior to travel.

Smoking

It is illegal to smoke on our vehicles. Smoking is not permitted on board any vehicles at any time. A fines of £120 can be issued for non-compliance.

Payments and Refunds

All vehicle hires are payable in advance. Payment details will be agreed at the time of booking.

Deposits or initial payments are non refundable.
Full payment or balance payments are due 28 days before the hire event.

Cancelations within 28 days of the hire date are non-refundable. Payments for personalized signs or branding cannot be refunded once the production process has started.

Any remaining balance of the hire charge is due in full no less than 28 days before the hire date, unless stated otherwise by the company. The hire will not go ahead unless full payment is received or if payment is received too late to organize the hire. Failure to complete full payment by the 28 day deadline can result in a total loss of the deposit and the reservation. The company will not be responsible for any losses direct or consequential for the loss of a reservation.

The company reserves the right to amend charges in the event of receiving altered instructions from the hirer such as changes of date, route, times or duration of the booking.

Special Event Dates

These are special calendar dates that occur infrequently ie Race Days and organized Parades.

Extra Charges

Additional charges such as but not limited to parking fees or entry fees will be levied in accordance with the charges imposed onto the company. Such charges are to be paid on demand by the hirer.

Waiting and Overtime Charges

Unless specified otherwise in the booking confirmation, prices are based upon direct journeys, departing at the time specified on the booking confirmation. The company reserves the right to charge for additional waiting time or hire time outside of the agreed booking schedule. Charges range from £80 to £240 per hour pro rata at the companies discretion subject to circumstances.

Age Restrictions

All hirers must be over 21 years of age. Any hire where the party includes a significant number (as determined by the company) of passengers under the age of 18, the company can require that a reasonable number of responsible adults be present throughout the duration of the hire.

Branding

Orders for branding is an instruction to the company from the hirer to produce branding material on the hirers behalf and install onto our vehicles in a safe manner. Ownership of any branding produced remains with the hirer and the company will dispose of any material post event unless it receives instructions otherwise. The hirer agrees that they own the copyright or have permission from the copyright holder to reproduce and display copyright material to be used in connection with branding or display on our vehicles. Copyright ownership of the artwork provided will remain the property of the hirer and /or original copyright holder and the company will make no claim to its ownership. In the event of cancelation by the customer branding costs are non-refundable. In the event that the company fails to fulfil the bus hire the maximum amount refundable is 20% of the branding costs.

The company reserves the right to refuse to display graphics or text which may be offensive or bring the company into disrepute.

Food and Drink

Food and Drink may not be taken onto, or consumed on the bus, unless by strict arrangement with the company and confirmation in writing by the company. An additional charge may be levied at the discretion of the company. If granted, the crew has final discretion to disallow excess qualities or food or drink on board especially that of Alcohol. The company reserves the right to charge a fee payable on demand if excessive cleaning is required.

Health and Safety

Passenger safety is of the highest importance. Passengers must behave in a responsible manner at all times and be fit and healthy to undertake the journey. The company accepts no liability for behavior which breaks the following guidelines:

- Passengers must not move between the lower and upper decks while the bus is in motion.
- Passengers must remain seated while the bus is in motion.
- Passengers must act in accordance with any reasonable instructions given by the crew. - Passengers must not distract the driver.

- If the bus has an open platform, passengers must vacate the platform area when the vehicle is moving.
- Passengers must not give the start signal via the bell system as this can endanger lives.

Authority of the Crew

Abusive and dangerous behaviour will not be tolerated. The authority of the crew such as the driver, conductor or guide is final. They have the right to stop the bus, cancel the hire or ask passengers to leave the bus at their discretion for reasons of health and safety, behaviour or any other reason. In any such event, the hirer will not be entitled to a refund or any form of compensation.

Damage

All our buses are thoroughly inspected before and after each hire for any damage including body-work and interior including fixtures and fittings and cosmetics. The company reserves the right to charge the hirer for any damage caused to its property caused by the negligence or misconduct of any passengers carried during the hire period. The company may demand an additional damage deposit before hire. The hirer is responsible to the company for any excessive cleaning costs.

Routes, journey times, pickup and set down points

Start, destination, pick-up and drop off points must all be agreed with the company before hire. The crew reserve the right not to undertake any additional stops or journeys during the hire.

For all hires, the driver has the final decision on the exact route taken. The driver will attempt to accommodate all reasonable requests from the hirer, but will consider local road restrictions, passenger safety, other road users and the vehicle itself when determining the route and any pick-up/ set-down points. The company makes no guarantee that the vehicle will perform the journey within any given time frame and the company shall not be accountable for any inconvenience, loss or damage which may arise from any journey time, delay or failure to complete a journey. Unless confirmed in writing by the company the hirer should not assume the vehicle/s will remain at any point between journeys or remain available for the hirers incidental use.

Journey Times

There is no guarantee that the vehicle will perform the journey in any given time and the company shall not be accountable for any loss, inconvenience or damage which may arise from any delay or detention or events outside of the companies control.

Substitution and Supplements

The company reserves the right to supplement or substitute its vehicles with a vehicle/s loaned to them by other operators without any preliminary notice or compensation due, in these instances the hirer will be bound by the terms and conditions of that operator.

In the event of a breakdown before or during a hire the company reserve the right to substitute transport either from our own fleet or from another operator, which could be of a different standard or specification in order to complete the journey.

In some cases the company may act as an agent for other bus operators or suppliers in this case the contract will be between the hirer and the supplier. If there are any failings with the contract, concerns or queries should be addressed to them.

In the case of supplementary or agent bookings the company may act as point of contact or coordinator, however the terms and conditions of the third party supplier shall apply directly to the hirer. In most cases this will mean that there are additional terms and conditions governing the contract as each supplier will have terms and conditions relating to their product or service. Where we act as agent this will mean that we have no contractual liability to you in respect of that service or product. However, we may still be liable to you if we have been negligent, we have misrepresented important information or have been in breach of any other relevant law.

Agency services or products are not an offer by the company to sell any product or service, but an invitation to you to make an offer to our suppliers. We are free to accept that offer on behalf of those suppliers or to reject it. In some cases, we may send you an email acknowledging receipt of your deposit or payment. Once we have processed your order, we will send a booking confirming the contract. If for any reasons, the offer is no longer available we will refund your payment.
